Access Legal suggests that you seriously consider declining an officer's requests to perform field sobriety tests because you are not legally required to perform them, and there are no consequences for declining FST's. You MUST agree to take a breath, blood or urine test if requested by the officer or the consequences include 18 months of driver license suspension. But if you do not perform Field Sobriety Tests, an officer may lack probable cause to arrest you due to lack of available evidence. Don't help the police make a case against you.
After being pulled over for DUI/DWI, you were probably requested to perform any number of the following field sobriety tests:
- Horizontal gaze nystagmus (HGN) test: A police officer puts a pen in front of your face and asks you to follow it with your eyes.
- Nine-step walk and turn test: You are told to walk heel-to-toe in a straight line and then turn around and walk back.
- One leg stand: A test that involves standing on one leg without using your arms for balance and counting out loud to 30.
- Alphabet test: The officer instructs you to go through a portion of the alphabet, starting and ending at a random letter of the officer's choosing.
- Finger touch test: You are instructed to touch the tips of your fingers to the tip of your thumb.
- Finger-to-nose test: A test that involves touching the tip of your nose with the tip of your finger.
Only the first three of these tests have been officially approved by the National Highway and Traffic Safety Administration. Furthermore, there is a proper way to administer each field sobriety test. Did the police officer who arrested you conduct the test properly?
